Page title: Terms and Conditions · Shopify slug: terms-of-service

1. Scope

(1) These Terms and Conditions ("Terms") apply to all contracts concluded through the online shop at vexon.com between the operator of vexon.com (hereinafter "VEXON", "we", "us") and the purchaser (hereinafter "you", "Client"). Our catalogue covers goods in the home and garden categories.

(2) A consumer under these Terms is any natural person who enters into a legal transaction for purposes that are predominantly unrelated to any trade or self-employed professional activity. A business client is any natural or legal person, or partnership with legal capacity, acting in the course of their commercial or independent professional activity when the contract is formed.

(3) Any deviating, conflicting or supplementary general conditions put forward by the Client shall only form part of the contract if their applicability has been expressly confirmed by us in writing.

2. Contracting Party and Contact

The purchase contract is formed between you and the operator of VEXON. Complete provider details are available on our Legal Notice page.

3. Conclusion of Contract

(1) The presentation of our home and garden goods in the online shop does not represent a legally binding offer; it serves solely as a non-binding online catalogue.

(2) By clicking the "Buy" / "Place order" / "Pay now" button, you submit a binding offer to purchase the items held in your shopping basket.

(3) Acknowledgement of receipt and acceptance of your order take place simultaneously — you will receive both immediately after placing your order via an automatically generated email. Upon despatch of this confirmation email, the purchase contract becomes legally binding.

(4) We retain the contract text and send it to you together with these Terms by email. The Terms currently in force may be consulted at any time at vexon.com/terms-of-service.

(5) Contracts are concluded in the English language.

4. Prices and Shipping Costs

(1) All prices displayed on the website are inclusive of the applicable statutory Value Added Tax. Any shipping and handling fees are shown separately during the checkout process.

(2) For deliveries to territories outside the European Union and the United Kingdom, customs duties, local taxes and other charges may be levied; these are the sole responsibility of the Client.

(3) Comprehensive details of delivery charges and estimated shipping windows are set out on our Shipping & Payment page.

5. Payment Terms

(1) The following payment methods are available: credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay, Google Pay and bank transfer. We reserve the right to exclude individual methods in specific circumstances.

(2) The full purchase price falls due upon conclusion of the contract.

(3) Where payment is made by credit card or PayPal, your account will be debited immediately upon completion of the order.

6. Delivery

(1) Goods are shipped to the delivery address provided by the Client. The applicable delivery windows are indicated on each product page and throughout the checkout process.

(2) Should delivery remain impossible after three attempts, we are entitled to withdraw from the contract. Any payments already made will be refunded without delay.

(3) Where force majeure occasions a delay, the delivery period will be extended accordingly. We will notify you of any such circumstances as promptly as possible.

7. Retention of Title

All delivered goods remain our property until the purchase price has been paid in full.

8. Right of Cancellation for Consumers

Consumers benefit from a statutory right of withdrawal. Full cancellation details and the model withdrawal form are available on our Cancellation Policy page.

9. Warranty and Liability for Defects

(1) The statutory provisions on defect liability apply. For consumers, the limitation period for defect-related claims is two years from the date of delivery.

(2) For second-hand goods, this limitation period is reduced to one year from the delivery date.

(3) Should any delivered item prove defective, please write to us at contact@vexon.com.

10. Liability

(1) We accept unlimited liability in cases of intent and gross negligence, and within the scope of applicable consumer protection legislation.

(2) In cases of ordinary negligence, liability is restricted to breach of a fundamental contractual obligation whose fulfilment is essential to the proper execution of the contract and upon which the Client may legitimately rely. In such cases, liability is limited to foreseeable, contract-typical loss.

(3) Liability for injury to life, limb or health is not affected by the foregoing.

11. Dispute Resolution

(1) The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.

12. Applicable Law and Jurisdiction

(1) The contractual relationship is governed exclusively by the laws of England and Wales, excluding the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only insofar as the protection afforded by mandatory provisions of the law of the consumer's country of habitual residence is not thereby withdrawn.

(2) Where the Client is a merchant, a body corporate under public law or a public-law special fund, the courts at our registered office shall have exclusive jurisdiction over all disputes arising from this contractual relationship.

13. Final Provisions

Should any provision of these Terms prove or become wholly or partially invalid, the validity of the remaining clauses shall be unaffected. The relevant statutory rule shall replace any void provision.
